Wildwood Clinic Wireless Internet Usage Policy
For the convenience of patients and visitors, Wildwood Family Clinic (“WFC”) is pleased to make available limited wireless access to individuals with compatible devices. This wireless Internet usage policy (“Policy”) establishes the terms and conditions for the proper use of wireless Internet access. WFC recommends that you review these terms and conditions carefully. By using the wireless Internet access, you agree to the following terms and conditions. If you do not agree to all terms and conditions, you CANNOT use the wireless Internet access.
PERMITTED USE: By using the wireless Internet access, you represent and warrant that:
- You are a patient, family member or friend of a patient or a visitor to WFC;
- You understand and agree to the filtering and monitoring of the wireless Internet access, as set forth below;
- You agree to comply with the rules and restrictions set forth below, together with any additional instructions that may be provided by WFC staff from time to time; and
- You assume responsibility for your device and for use of the wireless Internet access, and understand and agree to the disclaimers and limitations of liability set forth below.
EQUIPMENT AND SUPPORT: In order to use the wireless Internet access, you must supply your own personal device, equipped with compatible wireless functionality. WFC undertakes no obligation to provide any technical support related to the wireless Internet access or your device. Any technical support or assistance provided by WFC is at its sole discretion. You are solely responsible for maintaining the safety and security of your device.
FILTERING: The wireless Internet access has been equipped with a filtering program designed to block websites containing certain contact deemed objectionable by WFC, in its sole discretion. WFC does not undertake any duty to screen objectionable content available through the wireless Internet access, nor does it guarantee that the filtering program will be operational at all times or block access to all objectionable material. WFC does not assume any responsibility or liability for your intentional or inadvertent access to any objectionable websites or materials.
MONITORING: WFC has the right, but not the obligation, to monitor your use of the wireless Internet access, including access to information you create, store, send or receive. Subject to its other legal and regulatory obligations, WFC reserves the right to use or disclose any information obtained in the course of such monitoring, without notice to you, in order to maintain the integrity and security of WFC’s network and premises, to comply with any laws, regulations, court orders, subpoenas or other governmental procedures, or to improve the quality of the wireless Internet access generally. You hereby waive any expectation of privacy with respect to anything you create, store, send or receive when using the wireless Internet access.
PROHIBITED USES: You agree not to use the wireless Internet access for any unlawful purposes, or for any purpose permitted under this policy, including without limitation using or attempting to use the wireless Internet access to:
- Send, receive, print or display material that is unlawful, abusive, offensive, defamatory, obscene, pornographic, threatening, harassing, malicious or invasive of another’s privacy;
- Participate in any chat rooms, online gambling or other interactive sites;
- Disseminate unsolicited email or similar communications, including spam, chain letters and pyramid schemes;
- Intercept, collect or share personal information about any third party;
- Impersonate any person or falsely state or otherwise misrepresent your affiliation with any entity;
- Gain unauthorized access to or misuse any part of WFC’s network;
- Disable or circumvent any security devices, firewalls, virus protection or access restrictions;
- Tamper with the equipment, servers or networks connected to the wireless Internet access;
- Disseminate any malicious code, including disabling devices, Trojan horses and viruses;
- Infringe the copyright, trademark, patent, trade secret or other intellectual property rights of any third party;
- Violate any applicable federal, state or local laws or regulations; or
- Engage in any other activity deemed by WFC to be in conflict with the spirit and intent of this policy.
THIRD PARTY CONTENT AND WEBSITES: The wireless Internet access provides access to the websites and content of third parties. WFC does not endorse, support, authorize or sponsor the content of any third party website, and is not responsible or liable for your access to or use of such third-party website. If a third party links to WFC website, it does not indicate an endorsement, adoption, authorization, sponsorship, affiliation, joint venture or partnership between WFC and that third party. In some cases, WFC may not be aware that a third-party has linked to the WFC website.
TERMINATION OF USE: WFC reserves the right to terminate your use of the wireless Internet access at any time for any reason or no reason at all. WFC also reserves the right to disconnect or disable the wireless Internet access without notice for any reason.
INDEMNIFICATION: You agree to defend, indemnify and hold WFC, its directors, officers, employees, agents and affiliates harmless from and against any and all costs, damages, liabilities, claims, losses and expenses (including reasonable attorneys fees and expenses) arising out of or related to your use or misuse of the wireless Internet access or your breach or violation of this policy
GENERAL DISCLAIMER: The wireless Internet access, and all information and materials made available on or through the wireless Internet access is provided “as is” and without warranties of any kind, expressed or implied. All use of wireless Internet access is “at your own risk”. Without limiting the foregoing, WFC does not represent or warrant that your use of wireless Internet access will be safe, secure, compatible with your personal device or free from interruptions, errors or viruses or that information or materials available on or through the wireless Internet access will be accurate, complete, up-to-date, current or free from technical inaccuracies, typographical errors or alterations by third parties. You are solely responsible for maintaining the safety and security of your personal device and assume all risk of bringing the device onto WFC’s premises. WFC expressly disclaims any warranties of merchantability, fitness for any particular purpose, title, non-infringement or quiet enjoyment.
ADDITIONAL MEDICAL INFORMATION DISCLAIMER: Any medical information obtained through the wireless Internet access, whether from a WFC website or from a third-party website, should not be considered medical advice or a substitute for your physician’s advice. Your provider’s advice and your good judgment always should take precedence over any medical information obtained on the Internet. WFC does not guarantee the accuracy or appropriateness of such information as to any health condition. WFC disclaims any responsibility for any harm or damage associated with the use of such information. The wireless Internet access may provide access to health or medically related material that is not suitable for all audiences, including images and text of human anatomy and physiology. User discretion is advised and parental guidance is suggested.
LIMITATIONS OF LIABILITY: In no event shall WFC or its directors, officers, employees, agents or affiliates be liable to you or anyone else for any indirect, consequential, special, incidental, exemplary, punitive, or similar damages arising from or related to the wireless Internet access or use thereof, or for any decision made or action taken by you in reliance on the information and materials provided on or made available through any wireless Internet access, regardless of the form of action, whether in contract, tort, or otherwise, and even if advised of the possibility of such damages. To the maximum extent permitted by applicable law, WFC’s total punitive liability to you for all claims or suits arising from or related to the wireless Internet access, regardless of the form of action, shall not exceed one hundred dollars ($100), even if advised of the possibility of such damages, the existence of more than one claim or suit will not expand this limitation.
CHANGES TO POLICY: WFC may amend or modify this policy from time to time in its sole discretion. Your use of the wireless Internet access after being provided with, or otherwise being notified of, the amended or modified policy shall be deemed to be with full knowledge and acceptance of all terms and conditions therein.
ENTIRE AGREEMENT: This policy constitutes the entire agreement between you and WFC with regard to your use of the wireless Internet policy and supersedes all prior and contemporaneous negotiations, statements and agreements, whether written or oral, relating to the subject matter hereof. Except for any change this policy made by WFC from time to time, no amendment to or waiver of this policy shall be effective unless in writing and signed by a duly authorized representative of WFC. In the event any provision of this policy is held to be invalid or unenforceable, such provision will be changed and interpreted by a court of competent jurisdiction to accomplish the objectives of such provision to the greatest extent permitted under applicable law, and the remaining provisions will continue in full force and effect.
